In this paper, it is our purpose to argue for a processual conception of ill-person- identity. To do so, we will review some of the main answers that philosophy has given to the question of personal identity. We will review certain proposals on how to conceive illness and ill-person-identity, as well. Within the frame of a processual approach to ontology, we will focus on a non-dualistic processual-relational interpretation of biological organisms.

La historiografía ha revisado el falso mito de la «idílica convivencia» de las tres culturas. Para ello, ha alejado la cohabitación pacífica entre las tres religiones del imaginario colectivo medieval. Los vínculos entre la mayoría cristiana y la minoría judía sufrieron una serie de alteraciones a lo largo de la Edad Media como consecuencia de la coexistencia y de los episodios de violencia. Los espacios urbanos responden a un modelo de sujeto hegemónico que es criticado por distintas corrientes que abogan por ciudades pensadas desde la diversidad humana. Sin embargo, esas objeciones suelen llevarse a cabo sin cuestionar que el primer rasgo de aquel sujeto es su pertenencia a la especie homo sapiens y que, en consecuencia, la cuestión tanto territorial como de la urbe se centra en él. Esto es problemático, ya que convivimos con individuos de diferentes grupos biológicos. A raíz de (...) ello, mi objetivo es plantear la necesidad de un urbanismo crítico, interseccional y no antropocéntrico. Con ese fin, selecciono los cuestionamientos que recibe el modelo tradicional de habitante urbano por parte de las teorías de la discapacidad. Me detendré en el carácter capacitista del prototipo de referencia y las razones antropocéntricas que se emplean para su rechazo. Luego, argumentaré que esos motivos son especistas desde la perspectiva de la ética animal e interactúan con el capacitismo a la luz del enfoque animalista crip. Por último, daré paso al giro político para los derechos de los animales con la intención de exhibir sus implicancias en materia de urbanismo. (shrink)

A partir del trabajo colaborativo que emprendimos en ocasión de realizar el seminario “Trabajadores, industrialización y movilidades en Patagonia: una sociedad vigilada. Análisis local, en clave comparada”, entablamos un diálogo que nos permitió inscribir y pensar con clave continente rasgos asociados al devenir de la clase obrera y otros grupos subalternos en la Patagonia (a ambos lados de la delimitación formal de límites entre Chile y Argentina) y otras sociedades de frontera, como la región de Cuyo.

En el proceso de conformación de la clase obrera en la Patagonia argentina se destaca la fundamental presencia de los trabajadores de origen chileno en general, y de quienes eran oriundos de Chiloé en particular. Estos obreros eran necesarios para una región que sufría la escasez de fuerza de trabajo, pero a la vez estaban siempre sindicados como una latente amenaza, ya sea por su nacionalidad, su ideología o sus prácticas sociales. Los trabajadores chilenos sufrieron un permanente control que en (...) muchos casos desembocó en represión abierta, siendo los “chilotes” blanco de una especial discriminación. Trabajamos con un prontuario policial específico del Territorio Nacional del Chubut, realizado a José Modesto Barrientos, obrero petrolero de Yacimientos Petrolíferos Fiscales, detenido en varias ocasiones por situaciones de desorden público, ebriedad y, especialmente, por sospechas de actividades comunistas. Investigamos algunos rasgos de las prácticas obreras, las formas de resistencia y los ejes de la persecución política y social que desarrollaba la policía del territorio. Observaremos, además, ciertas características sobre la riesgosa labor que estos trabajadores desarrollaban. (shrink)

Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

Este trabajo persigue reflexionar sobre el estatuto ontológico de la comunidad en base a la figura de Nietzsche como arcano de la apuesta teórica tiqquniana. Así, a partir de las consideraciones que Nietzsche realiza sobre la vida, junto con los diagnósticos que Tiqqun despliega a partir de su _metafísica crítica_, se explorarán algunos de los pliegues del pensamiento de ambos autores tratando de iluminar una cartografía de la no pertenencia que sustituya la lógica identitaria de la comunidad moderna fundamentada en (...) el principio de humanismo. Dicha cartografía no solo persigue agotar el lenguaje político contemporáneo, sino que piensa en una forma política y comunitaria desarrollada desde el _pathos_ de la distancia, el éxtasis y la filosofía política an-árquica. El esfuerzo teórico aquí recogido ilumina y teje la presencia de Nietzsche en el pensamiento de Tiqqun manifestando el anhelo compartido entre ambos autores por desatar prácticas de libertad en la tarea de traer al mundo las vidas que aún están por venir. Reseña del libro: Dispositivos neoliberales y resistencias de Rodrigo Castro Orellana.

Background: This research explores how public awareness and attitudes toward donation and transplantation policies may contribute to Spain's success in cadaveric organ donation. Materials and Methods: A representative sample of 813 people residing in Andalusia (Southern Spain) were surveyed by telephone or via Internet between October and December 2018. Results: Most participants trust Spain's donation and transplantation system (93%) and wish to donate their organs after death (76%). Among donors, a majority have expressed their consent (59%), and few nondonors have (...) expressed their refusal (14%). Only a minority are aware of the presumed consent system in force (28%) and feel sufficiently informed regarding the requirements needed to be an organ donor (16%). Participants mainly consider that relatives should represent the deceased's preferences and be consulted when the deceased's wishes are unknown, as is the case in Spain. Conclusion: Public trust in the transplant system may contribute to Spain's high performance in organ donation. High levels of societal support toward organ donation and transplantation do not correspond with similar levels of public awareness of donation and transplantation policies in Spain. (shrink)

Así, Richir expone todo el entramado de la sustitución para, en último término, cuestionar sus propios límites y proponer un ensanchamiento hacia una fenomenología de lo inmemorial, del inconsciente fenomenológico, del apeiron, con ayuda de lo sublime. The debate over the determination of death has been raging for more than fifty years. Since then, objections against the diagnosis of brain death from family members of those diagnosed as dead-have been increasing and are causing some countries to take novel steps to accommodate people’s beliefs and preferences in the determination of death. This, coupled with criticism by some academics of the brain death criterion, raises some questions about the issues surrounding the determination of death. In this paper, we (...) discuss some of the main approaches to death determination that have been theoretically proposed or currently put into practice and propose a new approach to death determination called "weak pluralism" as a reasonable ethical and political alternative to respect diversity in death determination. Background: The high level of satisfaction of users of a health service is largely due to the fact that they receive excellent care from healthcare professionals. Compassionate care is an essential component of excellent care. But what do nurses understand compassion to be? Research objectives: To analyse the concept of compassion from the perspective of nurses in the Andalusian Public Health System, Spain. Research design: This is a qualitative study following the grounded theory model. Four focus groups and 25 in-depth (...) interviews were conducted. Participants and research context: A total of 68 nursing professionals working in the Andalusian Public Health System (Spain) participated. Theoretical sampling was used, with participants being recruited using the snowball technique. Ethical considerations: This research was approved by the Research Ethics Committee of the Centro-Almería Health District (CEICA 27/9/17). Findings: From the analysis of the data, four themes emerged that helped to understand the concept of compassion according to nurses: ‘Negative perception of the term compassion’, ‘Compassion and empathy as synonyms’, ‘Beyond empathy’, and ‘Effects of having a compassionate attitude’. Discussion: Nurses perceive the concept of compassion differently to each other and even contradictorily. This concept is imbued with cultural elements, which adds confusion to understanding it, and is even perceived as something negative similar to pity. Conclusion: Nurses confuse the concepts of empathy and compassion as if they were synonymous. Before considering training in compassion for healthcare professionals, it is essential to clarify the concept of compassion through educational interventions. (shrink)

Altruism and solidarity are concepts that are closely related to organ donation for transplantation. On the one hand, they are typically used for encouraging people to donate. On the other hand, they also underpin the regulations in force in each country to different extents. They are often used indistinctly and equivocally, despite the different ethical implications of each concept. This paper aims to clarify to what extent we can speak of altruism and solidarity in the predominant models of organ donation. (...) It also raises the ethical question of whether these categories are adequate as a basis for such models, bearing in mind that organs are a scarce resource and that a shortage of them may mean that fewer lives are saved or improved. El presente trabajo se ocupa del lugar de la religión en la última etapa de la obra de Habermas. En la primera parte se muestran las diferentes aristas de la cuestión de la religión, poniendo énfasis en los aspectos filosófico-políticos, sobre todo el que concierne a la “traducción” del lenguaje religioso al secular como un “requisito” de acceso a la esfera pública. En la segunda parte, se reconstruye, señalando sus límites o dificultades, el concepto de “traducción” en Habermas. Para ello, (...) se apela, además, a algunas categorías conceptuales propuestas por Jean-Marc Ferry. La traducción en este marco puede ser entendida en dos sentidos: como una reformulación semántica que apunta a ampliar el universo discursivo de origen (traducción como desencapsulamiento) y como una transformación de los géneros pre o para-argumentativos en argumentativos (traducción como cambio de género discursivo). According to resemblance nominalism, things have their properties in virtue of resembling other things. This unfashionable view is championed with clarity and rigor.

El artículo presenta una visión histórica de la sociedad mapuche y del vínculo “interétnico”; y por otro lado se refiere a los diversos modos de comprensión de “Chile”, para examinar el tema de la existencia o no de una “deuda histórica” con la sociedad mapuche. Remarca que con el advenimiento de la República, los mapuche dejaron de ser vistos como un pueblo o nación y comienzan a ser tratados como chilenos, con lo que se puso fin a la política colonial (...) de los parlamentos. Frente a esto, la sociedad mapuche no logró articular un frente común para encarar el nuevo momento histórico. Agrega que la “Pacificación de la Araucanía” y la “política reduccional” funcionaron no como un proyecto de “inclusión”, sino de “exclusión”. Tras presentar los enfoques de los recientes gobiernos en lo concerniente al tema, y el de los historiadores Gonzalo Vial, Vitale y Pérez, concluye con una propuesta que pasa por separarse de la cultura dominante, y elaborar un política “sensible a las diferencias”. Are intelligent machines really intelligent? Is the underlying philosoph- ical concept of intelligence satisfactory for describing how the present systems work? Is understanding a necessary and sufficient condition for intelligence? If a machine could understand, should we attribute subjectivity to it? This paper addresses the problem of deciding whether the so-called ”intelligent machines” are capable of understanding, instead of merely processing signs. It deals with the relationship between syntax and semantics. The main thesis concerns the inevitability of semantics for any (...) discussion about the possibility of building conscious machines, condensed into the following two tenets: ”If a machine is capable of understanding (in the strong sense), then it must be capable of combining rules and intuitions”; “If semantics cannot be reduced to syntax, then a machine cannot understand.” Our conclusion states that it is not necessary to attribute understanding to a machine in order to explain its exhibited “intelligent” behavior; a merely syntactic and mechanistic approach to intelligence as a task-solving tool suffices to justify the range of operations that it can display in the current state of technological development. Rodger et al have interestingly argued that xenotransplantation should, if possible, entail the use of genetic pain disenhancement to prevent otherwise unavoidable pain in ‘donor’ animals.1 Their argument relies on the empirical assumption that xenotransplantation offers a realistic solution to organ shortage, and that, due to the recent clinical developments and the lack of human donors, it will thus continue for the foreseeable future. We argue below that other options should be prioritised over xenotransplantation, and that so-called ‘non-sentientist’ harms are (...) undervalued in discussions on disenhancement. We do not challenge the empirical claim made by the authors. That is, xenotransplantation research might continue for the foreseeable future since organ demand is increasing. However, we disagree with the priority given to xenotransplantation over other solutions that are more morally desirable. We argue that, if we comply with the 3R principles (Replacement, Reduction, and Refinement of the use of animals in research) and follow a minimal welfarist reasoning (to which the authors seem to adhere), then (1) the principle of replacement demands the use of non-animal alternatives if possible and (2) there are alternative solutions that lead to morally better consequences. Formal tools are attributed central roles in organizing work within many modern workplaces. How should one comprehend the power of these tools? Taking the medical record as an example, this article builds on recent calls to overcome the dichotomy between the formal and the informal and proposes an understanding of the generative power of such tools that does not attribute mythical capacities to either tool or human work. To do so, it is important to look both at the history offormal (...) tools and to their real-time use in concrete work practices. These steps toward a sociology of the formal are crucial for a more comprehensive understanding and evaluation offormal systems in practice. (shrink)

Why do forces compose according to the parallelogram of forces? This question has been controversial; it is one episode in a longstanding, fundamental dispute regarding which facts are not to be explained dynamically. If the parallelogram law is explained statically, then the laws of statics are separate from and “transcend” the laws of dynamics. Alternatively, if the parallelogram law is explained dynamically, then statical laws become mere corollaries to the dynamical laws. I shall attempt to trace the history of this (...) controversy in order to identify what it would be for one or the other of these rival views to be correct. I shall argue that various familiar accounts of natural law not only make it difficult to see what the point of this dispute could have been, but also improperly foreclose some serious scientific options. I will sketch an alternative account of laws that helps us to understand what this dispute was all about. (shrink)

Editors' introduction to 'James Woodward: Causal and explanatory asymmetries'.

Let us show how property is grasped as an institutional fact. If Jones steals a computer, he does not own it in the sense of property, but only exercises control towards it. If he buys the computer, he controls it too, and moreover owns it in the sense of property. In other words, simply exercising control towards something is a brute fact. This control counts asproperty only in a certain context: the computer counts as Jones’s property only if he got (...) it through a licit transfer. This is why property is not a brute fact, and is therefore an institutional fact. The same kind of reasoning applies to privacy. When a personal information P about Jones is openly diffused, it seems that P becomes public. From this point of view, a violation of privacy equates to a publication. The problem about this account is the following: who would call “publication of a book” the hacking of it on its author’s computer? No one, because the word “publication” is an institutional word that only refers to a licit diffusion. Considering this answer, we may conclude as follows: if the diffusion of P is illicit, P still countsas private, even if everyone knows about it. If that conclusion is true, privacy is an institutional fact. (shrink)

Gilles Deleuze’s research during the 1980s focused on the 17th century German thinker G. W. Leibniz. In 1988, Deleuze published Le Pli, which forms part of a series of works on modern philosophy. This book displays Deleuze’s attention to the interpretations of contemporary commentators on modern philosophy, in this case, on Leibniz. In this context, there occurred a brief and important dialogue between Deleuze and Christiane Frémont, the French commentator and translator of Leibniz, with regard to their respective interpretations of (...) the great German philosopher. This article intends to give an account of the main topics present in that conversation. Firstly, we can say they involve 1) the problem of body and the Leibnizian vinculum substantiale, 2) the question of singularities, 3) the principle of economy and incompossibility, and 4) the Deleuzian concept of vice-diction. Our hypothesis in this study is that the readings made by both authors of the German thinker are mutually involved. It is essential, in order to support this hypothesis, to make precise the demarcations of relations between such readings. For this reason, our research will focus on Frémont’s study Singularités, individus et relations dans le système de Leibniz (2003) and on Deleuze’s work Le Pli (1988). We hope to determine the topics that emerge in the relationship, and to specify convergences and divergences of interpretation. (shrink)

The thesis we develop in this essay is that all humans are endowed with a moral faculty. The moral faculty enables us to produce moral judgments on the basis of the causes and consequences of actions. As an empirical research program, we follow the framework of modern linguistics.1 The spirit of the argument dates back at least to the economist Adam Smith (1759/1976) who argued for something akin to a moral grammar, and more recently, to the political philosopher John Rawls (...) (1971). The logic of the argument, however, comes from Noam Chomsky’s thinking on language specifically and the nature of knowledge more generally (Chomsky, 1986, 1988, 2000; Saporta, 1978). If the nature of moral knowledge is comparable in some way to the nature of linguistic knowledge, as defended recently by Harman (1977), Dwyer (1999, 2004), and Mikhail (2000; in press), then what should we expect to find when we look at the anatomy of our moral faculty? Is there a grammar, and if so, how can the moral grammarian uncover its structure? Are we aware of our moral grammar, its method of operation, and its moment-to-moment functioning in our judgments? Is there a universal moral grammar that allows each child to build a particular moral grammar? Once acquired, are different moral grammars mutually incomprehensible in the same way that a native Chinese speaker finds a native Italian speaker incomprehensible? How does the child acquire a particular moral grammar, especially if her experiences are impoverished relative to the moral judgments she makes? Are there certain forms of brain damage that disrupt moral competence but leave other forms of reasoning intact? And how did this machinery evolve, and for what particular adaptive function? We will have more to say about many of these questions later on, and Hauser (2006) develops others. However, in order to flesh out the key ideas and particular empirical research paths, let us turn to some of the central questions in the study of our language faculty.. (shrink)

In recent years, a number of cultural theorists have made important contributions to the study of the body’s surface. Despite their importance, however, none of these contributions provides us with a systematic framework for understanding why the body’s surface — its skin — matters to the extent that it does. In this article, I seek to provide such a framework and, in doing so, to shed light on why the skin and the self seem to share a special and sometimes (...) strained relationship. To this end, I will present a critical introduction to the work of two contemporary Anglo-American psychoanalysts: Esther Bick and Thomas Ogden. Throughout this introduction, I will show how both Bick and Ogden — despite the fact that they are almost completely unknown outside clinical circles — offer up a host of conceptual tools that could prove useful to cultural theorists interested in making sense of the relationship between the skin and the self.
